MobiGate Service and Usage Agreement

This agreement sets forth the terms of use between MobiGate (hereinafter referred to as the “Provider” or “MobiGate”) and individuals or legal entities who visit https://mobigate.io and/or use its services (hereinafter referred to as the “Customer” or “User”). By purchasing or using any service via MobiGate, you are deemed to have accepted all terms and conditions of this agreement in advance.

2. Scope and Description of the Service
2.1. MobiGate provides “Mobile Proxy” services to its customers through mobile networks with dynamic or static IP rotation.
2.2. Delivered proxy credentials (IP, Port, Username and Password) are sent automatically or manually to the Customer’s dashboard/email address after the payment is confirmed.
2.3. Since service quality depends on the real-time status of cellular network operators, MobiGate does not guarantee 100% uninterrupted speed; however, it commits to keeping its hardware infrastructure operating at maximum efficiency.
3. Legal Obligations and Turkish Law No. 5651
3.1. MobiGate operates in compliance with the laws of the Republic of Turkey. Under Law No. 5651 (“Law on Regulation of Publications on the Internet and Combating Crimes Committed through Such Publications”), IP assignment logs on the system (internal IP, external IP, date and time stamps) may be stored in encrypted form for the legally required periods.
3.2. In accordance with legal and official requests from the competent authorities of the Republic of Turkey (Courts, Prosecutors’ Offices, ICTA/BTK, etc.), the Customer’s log records and membership information may be shared with the relevant authorities. The Customer accepts this in advance.
4. Strict Prohibited Uses
The Customer may not use the purchased service for any of the actions listed below. If any violation of these rules is detected, the Customer’s service will be terminated immediately without any warning or notice, and absolutely no refunds will be issued.
5. Customer Responsibilities
5.1. The Customer is solely responsible for the security of the proxy accounts, usernames and passwords assigned to them. MobiGate cannot be held liable for legal issues arising from third parties gaining access to the account.
5.2. The Customer accepts that the information provided during registration (Name, Email, etc.) is accurate and up to date.
6. Pricing, Refund Policy, and Cancellation
6.1. MobiGate services are provided on a pre-paid basis. Services are not activated until the payment is completed.
6.2. Refund Terms: Since the purchased services are digital products and are delivered instantly, they are not subject to the right of withdrawal. However, if the service cannot be used at all for 24 hours due to a verified issue originating from the MobiGate infrastructure, a proportional refund or service time extension may be provided.
6.3. Users who violate the prohibited uses (Section 4) or endanger the hardware/software integrity of the system will have their services terminated immediately. In such cases, no refunds will be provided under any circumstances, including for unused days or unused quota.
7. Disclaimer of Liability
7.1. MobiGate does not guarantee that its proxy services will not be blocked, banned or restricted on third-party websites (Google, social media platforms, etc.), or that geolocation will always be displayed flawlessly.
7.2. In case of any service interruption or data loss, MobiGate’s maximum financial liability is limited to the monthly fee paid by the Customer for that service.
8. Changes to the Agreement and Termination
8.1. MobiGate reserves the right to unilaterally amend this agreement without prior notice. The updated agreement becomes effective as soon as it is published on the website.
8.2. In case of breach of this agreement or violation of strict prohibited uses, MobiGate may immediately and unilaterally terminate the Customer’s account, active IP assignments, and all services. Following termination, the account will be permanently closed and any rights or refund claims of the Customer within the system will be deemed invalid.
9. Dispute Resolution
Any dispute arising from the implementation and interpretation of this agreement shall be governed by the laws of the Republic of Turkey, and the competent courts and enforcement offices shall be those of the Republic of Turkey.
